Eligibility
The Sweepstakes is open only to legal residents of the United States or the District of Columbia, who are at least eighteen (18) years of age or older as of the time and date of entry.
Employees, officers, and directors of Nissin Foods (USA) Co., Inc. (“Sponsor”), The Cornett Group Inc (“Administrator”), Golin/Harris International Inc., and their respective parent companies, affiliates, subsidiaries, advertising, contest, fulfillment, and marketing agencies (collectively, the “Sweepstakes Parties”), their immediate family members, and those living in the same household as such individuals (whether legally related or not) are not eligible to participate in the Sweepstakes or win a prize.
For purposes of this Sweepstakes, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children, grandchildren, and their respective spouses. Those living in the same household shall mean people who share the same residence at least three (3) months a year, whether legally related or not.
Void where prohibited by law, rule, or regulation. All federal, state, and local laws and regulations apply. By participating in the Sweepstakes, you unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Sponsor, including the interpretation of these Official Rules, administration of the Sweepstakes, selection of the winners, and Sponsor’s exercise of discretion, which will be final, non-appealable, and binding in all respects.
Sweepstakes Period
The Sweepstakes begins approximately at 12:00 PM Eastern Time (“ET”) on September 29, 2025, and ends at 11:59 PM ET on October 3, 2025 (“Sweepstakes Period”). Sponsor’s clock is the official timekeeping device for this Sweepstakes.
How to Enter
To enter the Sweepstakes, during the Sweepstakes Period:
- Log into your public Instagram account;
- Navigate to the designated Sweepstakes post on the Original Cup Noodles official Instagram page [@originalcupnoodles];
- Comment “Bistro Please” on that specific post.
Limit one (1) entry per person and Instagram account during the Sweepstakes Period. Duplicate, automated, or bulk comments will not increase your chances of winning and may result in disqualification. Entries must comply with Instagram’s community guidelines.
Note: Internet access and a valid public Instagram account are required to enter. This may present a barrier to entry for individuals without internet access.
Winner Selection and Notification
The winner will be selected at random from all eligible entries received during the Sweepstakes Period. The potential winner will be notified via Instagram direct message and/or comment reply. If the winner does not respond within the specified time frame or fails to provide required information, an alternate winner may be selected.
Prize
The winner will receive one (1) Microbistro microwave model and one hundred (100) Cup Noodles Ramen Bistro units. Prize is non-transferable and no cash or other substitutions are permitted except at Sponsor’s sole discretion.
Approximate Retail Value (“ARV”) of total package is $450 USD. Prizes are non-transferrable and cannot be substituted or redeemed for cash. All federal, state, and local taxes on prizes are the sole responsibility of the winner.
General Conditions
Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes. In such event, the Sponsor may aware the prize in a random drawing from all eligible, non-suspect entries received up to the time of impairment. Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner.
Privacy
Information collected from entrants is subject to Sponsor’s Privacy Policy available at https://nissinfoods.com/privacy-policy. By participating in the Sweepstakes, entrant agrees to all of the terms and conditions of the Sponsor’s Privacy Policy. In the event of any discrepancy between the Sponsor’s Privacy Policy and these Official Rules, these Official Rules shall control and govern.
Entry Information and Sweepstakes Communications
As a condition of entering the Sweepstakes, each entrant gives consent for Sponsor to obtain and deliver his or her name, address, and other information to third parties for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations, and rules. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes winner’s list.
Waivers and Disclaimers
The Sponsor, Administrator, and all [IS1] “Sweepstakes Parties”) assume no responsibility or liability for:
(a) Lost, late, misdirected, incomplete, stolen, inaccurate, undelivered, or delayed entries, comments, messages, or notifications;
(b) Any incorrect or inaccurate information associated with an entry, whether caused by entrants, tampering, hacking, or by any equipment or programming used in this Sweepstakes;
(c) Unauthorized access to, or theft, destruction, or alteration of entries or Instagram accounts;
(d) Technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines, internet connectivity, hardware, software, servers, or network equipment;
(e) Inaccessibility or unavailability of Instagram or any features therein, or human error which may occur in the administration of the Sweepstakes or the processing of entries; or
(f) Any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Sweepstakes or receipt or use of any prize.
[IS2] Dispute Resolution
The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in the State of California, and any other court with jurisdiction over the parties.
In arbitration, there is no judge or jury, and review is limited. The arbitrator’s decision and award shall be final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction.
Except as set forth above, any claim, suit, action, or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the Streamlined Arbitration Rules and Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. If JAMS is unwilling or unable to set a hearing date within fourteen (14) days after a party files a Demand for Arbitration, either party may elect to have the arbitration administered by the American Arbitration Association (“AAA”) or another mutually agreeable arbitration provider.
If an in-person hearing is required, the hearing will take place in Los Angeles County, California. The law that applies to these Official Rules will also apply in arbitration.
Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions. However, if for any reason a court or arbitrator determines that this restriction is unconscionable or unenforceable, then the agreement to arbitrate shall not apply, and the dispute must be brought in a court of competent jurisdiction in Los Angeles County, California.
Sponsor agrees to pay the administrative and arbitrator’s fees required to conduct the arbitration (excluding any travel or other costs incurred by the entrant in attending the arbitration hearing). Notwithstanding this arbitration agreement, either party may bring qualifying claims in small claims court.
